These terms govern your use of nippyindex.com (the "Service"), operated by Nippy Index.

("we", "us"). By using the Service you accept these terms. If you do not accept them, please do not use the Service.

What the Service is

Nippy Index is an environmental information tool. It describes physical water and weather conditions at UK locations using interpreted data from third-party meteorological, marine, tidal and bathing-water sources. It is intended for adults with an interest in understanding the factors that influence open-water swims.

What the Service is not

The Service describes conditions only. It does not tell you whether any location is safe, suitable or accessible, does not give go/no-go advice, and makes no assumptions about your ability, fitness or experience. The absence of any reported hazard does not mean a location is safe. The Service is not a substitute for your own judgement, local knowledge, or official safety guidance.

Accuracy and availability

The information is provided "as is" and "as available". Conditions in the natural environment change quickly and the underlying data can be delayed, incomplete or incorrect. We do not warrant that the information is accurate, current, complete or uninterrupted, and we may change or withdraw any part of the Service at any time.

Your responsibility

You are solely responsible for any decision you make about entering the water or any activity you undertake. You must make your own assessment of the conditions and your own ability, and follow official safety advice. Never rely on the Service alone.

Links and related products

The Service may contain links to NippyDips (nippydips.co.uk) and other sites. Some links may be affiliate or product links. We are not responsible for the content of external sites, and any purchase you make is subject to that retailer's own terms.

Intellectual property

The Service, its design, text, scoring methodology and underlying datasets are owned by us or our licensors and are protected by law. You may use the Service for your own personal, non-commercial use. You must not copy, scrape, republish or commercially reuse the content or data without our written permission.

Liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under English law.

Subject to that, to the fullest extent permitted by law we are not liable for any loss or damage arising from your use of, or reliance on, the Service or the information it presents, including any decision to enter or not enter the water. The Service is provided for general information only.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your home jurisdiction.
